Santa Fe, New Mexico – Defense attorneys representing actor Alec Baldwin are seeking to have a grand jury indictment against him dismissed in the fatal shooting of cinematographer Halyna Hutchins on the set of the Western movie “Rust”. The incident, which occurred on October 21, 2021, led to Baldwin being charged with involuntary manslaughter earlier this year.
Baldwin’s lawyers argue that the prosecution unfairly influenced the grand jury proceedings, diverting attention away from evidence and witnesses that could potentially exonerate the actor. They claim that this prevented the jury from hearing testimony from director Joel Souza, who was injured in the shooting, as well as assistant director Dave Halls and props master Sarah Zachry.
In a court filing, the defense asserts that the grand jury did not receive crucial testimony and documents that were favorable to Baldwin’s case. They also argue that the jury was not informed of their right to review and request this information.
Prosecutor Kari Morrissey has declined to comment on the motion, stating that a response will be filed with the court.
Baldwin’s defense team further alleges that the grand jury was presented with inaccurate and one-sided testimony regarding the revolver involved in the shooting. Meanwhile, “Rust” armorer Hannah Gutierrez-Reed, who was found guilty of involuntary manslaughter, is currently awaiting sentencing.
Baldwin has maintained his innocence, claiming that he never pulled the trigger of the gun and only pulled back the hammer. The incident has raised questions about on-set safety protocols and the handling of firearms in the film industry.
The actor is scheduled to stand trial in July to face the involuntary manslaughter charge. The outcome of his attempt to have the indictment dismissed will be determined by the court.
