Renowned Attorney Challenges Cannabis Laws in Austin by Boldly Selling CBD Products and Inviting Cops to Raid his Dispensary

Austin, Texas – Adam Reposa, a notorious attorney known for his controversial courtroom conduct and relentless demeanor, has pushed the limits of selling marijuana in Austin. His operation, ATX Budtenders, openly sold cannabis through a website, a dedicated phone line, and a house with a distinctive pink ice cream truck. However, Reposa’s venture came to a halt on January 22 when law enforcement conducted a raid on his property.

During the raid, law enforcement seized unspecified amounts of marijuana, THC edibles, psilocybin mushrooms, rifles, cell phones, legal documents, and US currency. Despite the presence of two ATX Budtenders dispatchers during the search, no arrests or citations were made. Reposa claims that approximately 100 pounds of cannabis was confiscated, but argues that it was all legal CBD, not exceeding the federal threshold for charges.

The raid, led by the Drug Enforcement Administration (DEA), involved assistance from local sheriff’s officers, including the SWAT team. However, Reposa questions whether it can be considered a DEA-led raid since it was not executed by federal agents from the Department of Justice. Nevertheless, the investigation into Reposa’s dispensary began in mid-November based on tips received on the DEA Tip Line.

Despite the raid, Reposa has not been charged with a crime, which he views as law enforcement robbing cannabis dealers. Frustrated by the lack of charges, Reposa has embarked on a mission to go to prison, intending to use the case as an opportunity to challenge unjust cannabis laws and make a statement against prosecutors. He plans to represent himself in court if prosecutors decide to bring a case against him.

One notable development in the case is the recusal of Travis County District Court. District Attorney José Garza has stepped back from prosecuting the matter and appointed a pro tem prosecutor. The reason for Garza’s recusal and the identity of the pro tem prosecutor remains unclear.

Reposa’s controversial stance is fueled by a conviction that once it is established that marijuana is not dangerous, the government’s ability to prosecute non-dangerous drug offenses should be called into question. He believes that the fundamental issue goes beyond marijuana legalization and touches on the concept of liberty.

With no charges filed against him yet, Reposa continues his defiant stance against what he perceives as an unjust system. He hopes to challenge the government’s authority to prosecute non-dangerous drugs and make a stand for personal freedom. The outcome of his crusade remains uncertain, but Reposa remains resolute in his fight against the existing cannabis laws.
