Henderson, Ky. – After deliberating for just 40 minutes, a jury in Henderson convicted Oscar Rax Xi on two counts of child molesting tied to allegations that he sexually abused an 8-year-old.
The accusations came to light in July 2023 when Holly’s House conducted an interview that revealed the abuse. It was discovered during the investigation that Xi had repeatedly assaulted the child and employed tape to prevent the victim from screaming. Throughout the process, Xi expressed intentions of fleeing to his native Guatemala.
Prosecutor Diana Moers conveyed the critical role played by the young survivor, now 10, whose testimony was pivotal in securing the verdict. “This outcome would have been impossible without the brave testimony of the survivor,” Moers stated, emphasizing the intention to seek a severe prison sentence for Xi followed by expedited deportation.
Moers further highlighted the emotional weight of the testimony, which she described as deeply disturbing, yet crucial to the jury’s swift decision-making process. “It is harrowing to hear the atrocities recounted by a child, but the juror’s faith in these young voices is unwavering,” she remarked, adding her commitment to continually advocate for vulnerable victims.
The community has rallied behind the young survivor, with Moers expressing hope that the child finds a loving and supportive environment to overcome the trauma endured. She promised to push for the maximum sentence against Xi, condemning his actions as having profoundly negative impacts on the child’s well-being.
Xi’s sentencing is slated for August 14 before Judge Les C. Shively. The conviction marks a significant moment of justice and underscores the importance of listening to and validating the experiences of young victims in court proceedings. The case also highlights the often-overlooked bravery displayed by children forced into unimaginable situations, serving as a reminder of the ongoing fight against child abuse.
