Jefferson County, MO – A recent legal battle involving a daycare property ended with a jury award in Jefferson County Circuit Court. Plaintiff William Wunderlich had sued Giggle Buggs Child Care and Learning Center LLC, along with individuals Orson Guyton and Sandra Hatchell, for multiple claims including breach of lease and contract fraud. However, the award given was significantly less than Wunderlich had originally sought.
In 2016, Wunderlich initiated the lawsuit alleging that the defendants failed to adhere to the terms of a property lease and a promissory note intended for property enhancements. Additional allegations included conversion and violations under the Missouri Uniform Fraudulent Transfer Act. Although the court dismissed the claims related to fraudulent transfer and representations, the jury found the defendants liable for the breach of the lease.
During the proceedings led by Judge Travis Partney, the jury, after a three-day deliberation, awarded Wunderlich $57,348. This amount was a fraction of the initial demands which began at $435,406.89 and escalated to $750,000 just before the trial commenced.
Interestingly, Wunderlich, along with attorney Robert L. Reeser from Wunderlich & Associates in High Ridge, represented himself. The defendants were represented by Corey L. Kraushaar and Remington Harris of St. Louis-based firm Brown & James. After the verdict, Kraushaar expressed his client’s relief with the jury ruling in their favor on the conversion claim.
Wunderlich’s team did not immediately respond to requests for comments following the jury’s decision.
