Philadelphia, Pa. – A California family has filed a lawsuit against popular toy and game manufacturer Hasbro after their toddler suffered permanent disability as a result of consuming a gummy candy. The incident occurred on December 13, 2022, and was captured on video by the family’s Ring camera.
The family alleges that their three-year-old daughter, Amelie, began choking on one of the Candy Land Gummy Dots, leading to a frantic and unsuccessful attempt to dislodge the candy. Tragically, Amelie was deprived of oxygen for a prolonged period of time, resulting in permanent brain damage and spastic quadriplegia, a form of cerebral palsy. She is now unable to control most bodily functions and relies on a feeding tube for nourishment.
The lawsuit accuses Hasbro of failing to provide sufficient warning about the potential dangers of the Candy Land Gummy Dots. The family’s attorney, Thomas Bosworth, stated that the candy was a “ticking time bomb” and emphasized their intention to pursue justice for Amelie.
According to court documents, the Candy Land Gummy Dots were allegedly manufactured in a manner that rendered them unreasonably dangerous due to their extreme stickiness and inability to break down with the introduction of human saliva. The family is seeking more than $50,000 in damages, including compensation for the brain damage, spastic quadriplegia, neurogenic bladder, and neurogenic bowel disorder that Amelie now suffers from.
Bosworth called for the removal of the Candy Land Gummy Dots from store shelves or the addition of comprehensive warnings on the product label, following California consumer protection laws. The family hopes that Frankford Candy & Chocolate Co., Inc. and Hasbro will do what is right to prevent similar incidents in the future.
