SEOUL, South Korea– Seoul Semiconductor Co., Ltd. (SSC), a global leader in LED products and technology, has taken legal action against retail giant Amazon. The company filed a patent infringement lawsuit in the European Unified Patent Court, seeking an injunction to stop the sale of infringing products.
Over the past five years, SSC and its affiliates have successfully obtained 15 permanent injunctions for patent infringement in courts across the United States, Germany, France, and the Netherlands. However, the company found that filing lawsuits in individual countries was not the most efficient way to enforce patents against infringing products.
The European Unified Patent Court, established in June 2023, offers comprehensive jurisdiction over patent litigation in Europe. If SSC’s lawsuit is successful, it could result in injunctions and damages orders that apply simultaneously in 17 European countries, including Germany, France, and Italy. This would enable SSC to prevent the distribution of infringing products throughout Europe with just one lawsuit.
The asserted patent in this legal battle relates to a groundbreaking technology that allows for the adjustment of brightness and color in LED lighting products over time. This solution is widely utilized in smart lighting products and color-tunable lighting. Another patent being asserted in the lawsuit pertains to heat dissipation in LED packages, which is crucial for automotive lighting where heat management is essential.
Han-seon Park, the Executive Vice President of SSC’s marketing department, emphasized the importance of fair market opportunities and the respect for intellectual property. Park expressed concern that some large LED companies are distributing infringing products without due consideration for intellectual property rights. She believes this kind of behavior prevents fair competition and undermines efforts towards a society built on fairness.
Seoul Semiconductor is the second-largest global LED manufacturer in the world, excluding captive market rankings. The company holds more than 18,000 patents and offers a diverse product portfolio. They mass produce innovative LED products for various applications, including indoor and outdoor lighting, automotive, and IT products. Their advancements in LED technology, such as the package-free LED WICOP, high-voltage AC-driven LED Acrich, and ultraviolet clean technology LED Violeds, have become industry standards.
By taking legal action against Amazon, SSC aims to protect their innovative technology and ensure that fair competition prevails in the market. The lawsuit filed in the European Unified Patent Court could have significant implications for the distribution of infringing LED products throughout Europe. As the legal battle unfolds, the outcome will shape the future of the LED industry and the protection of intellectual property rights.
